Park Rules

The Bend community is enormously proud of its park system. Our beautiful parks play host to a wide variety of activities throughout the year, such as community-wide cultural events, recreation programs, sporting events, family picnics, and quiet relaxation.  Our park system is recognized throughout the Pacific Northwest as one of the best! 
 
The following rules and regulations have been developed to make sure that Bend's park system remains beautiful, inviting and safe for the community. 
We ask for your cooperation to ensure the integrity of the park system remains intact.  If you have specific questions, please call Park Services at (541) 388-5435. 


BEND METRO PARK & RECREATION DISTRICT
RULES AND REGULATIONS
 

ARTICLE I

GENERAL USE OF PARK, RECREATION AREAS AND PROGRAMS

1. No person shall use abusive, threatening, boisterous, vile, obscene or indecent language or gestures, nor shall any person cause, attempt to cause, or bring about a disturbance in any District park or recreation area.  No person shall conduct him/herself so as to unreasonably distract or disturb others in the peaceful enjoyment of any District park and recreation area or program.

2. No person shall deface, destroy or damage any District park and recreation area or the improvements thereon, or waste material or supplies provided for the comfort of the general public.

3. No person shall pick, injure, dig, probe or remove any vegetation, mineral or material from any District park or recreation area except by written authorization by the Executive Director or their designee.

4. No person shall place or dump any trash, refuse, solid waste, grass clipping, leaves, limbs, personal property or other unauthorized matter in any District park or recreation area.

5. No person shall wash any clothing or other material or equipment or clean any fish or introduce or place any polluting substance, waste or litter in any lake, stream, spring, pond, swimming or wading pool, fountain, or upon the grounds in a District park or recreation area.

6. Hitting golf balls, using archery equipment, paint ball guns, discus, javelin, shot put, model aircraft or other projectiles is prohibited in District parks unless otherwise posted.

7. Use of metal detectors is allowed by written permit.

8. Use of charcoal briquettes or fires is prohibited in District parks, except by written permission of Executive Director or their designee.

9. Selling of alcohol in District parks is allowed only under permitted uses by the Executive Director. The District may require a certificate of insurance for the activity. A permit to sell alcohol must be obtained from the City of Bend and/or County authorizing that group or individual to sell such product. Consumption of alcohol in public parks is allowed under permitted uses and in accordance to local, state, and federal laws allowing such use.

10. Concession sales or distribution of material in District parks will be allowed only by
written permission by the Executive Director or their designee and must comply with City and/or County ordinances and/or regulations governing concession sales.

11. Canopies and tents are allowed only under permitted use.

12. No unauthorized person shall practice, carry on, conduct or solicit for any trade, occupation, business or profession.

13. No person over the age of six (6) years is allowed to enter the restroom, washrooms, or locker facilities designated for the opposite sex, unless assistance is necessary.

14. Use of mechanical loudspeaker or amplified music, sound or voice is prohibited except when authorized by the Executive Director, or in connection with use of any amphitheater or special event provided the music or sound is within the prescribed levels governed by State or local law, measured at the property boundary.

15. No person shall conduct or participate in any tournament, camp, or organized sporting event, which the Executive Director has not specifically authorize. Any unauthorized event has priority use of the facility.

16. Use of any park facility for an organized event must be prescheduled with and approved by the Executive Director.

17. No person shall advertise an event, meeting, activity, or the time permitted hours, or usage of any event, meeting or activity to be held or conducted in a park facility unless prior approval by the Executive Director has been granted.

18. No political signs or banners may be posted within any park or recreation area except in those facilities that are reserved for that purpose.


ARTICLE II. 

HUNTING AND FISHING

1. No person shall discharge any firearm, weapon, fireworks or explosives of any type; nor pursue, hunt, trap, molest or capture any wild bird or animal in a District park or recreation area unless authorized by the District.

2. No person shall fish in the waters within District park or recreation areas that are not regulated by ODFW, except those waters specifically designated by the Executive Director for such purposes.

 

ARTICLE III. 

VEHICLES

1. No motorized vehicles shall be operated or parked within any District park and recreation area except:

a. on roadways and parking areas specifically designated for motorized vehicles; or

b. maintenance vehicles of the District; or,

c. by special permit,

d. public safety vehicles are exempt.

2. No person shall operate a vehicle carelessly or in such a manner as to endanger the rights and safety of others.

3. Use of parking areas at District facilities and parks is restricted to users of those sites and limited to a reasonable time. All-day and overnight parking unrelated to park facility use is prohibited.

4. No person shall park a vehicle at District facilities or parks while engaged in an activity (i.e. working at a neighboring business) not associated with the District facility or park.


ARTICLE IV. 

ANIMALS

1. No domestic animals shall be allowed upon any District park or recreation area except:

a. Dogs on a leash and owner picks up after animal.

b. Dogs may be off-leash in areas designated as such, but must be under verbal control of dog owner or caretaker.

c. Horses on equestrian signed trails only in parks identified for that use.

d. by special use permit. 


ARTICLE V. 

CAMPING

1. No person shall camp overnight in any District park or recreation area except with specific written authorization of the Executive Director, or an area that has been designated.

2. An area that has been designated for camping may be used for that purpose.


ARTICLE VI.

USE OF TOBACCO PRODUCTS

1. Organizers of group gatherings, special events, and sports programs are granted the authority to prohibit the use of tobacco products at said event.

ARTICLE VII. 

CLOSURES

1. District parks are closed from 10:00pm to dawn unless otherwise posted.


ARTICLE VIII. 

OTHER RULES & REGULATIONS

1. The Executive Director shall have the authority to establish rules and regulations that govern the use of specific park and recreation facilities in order to operate the facility in a productive, meaningful, and safe manner.


ARTICLE IX

EXCLUSION

1. In addition to other measures provided for, any peace officer or designated park district employee may exclude from all or a part of the district facilities any person who violates any provision of the rules and regulations of the Bend Metro Park & Recreation District or violates any law of the State of Oregon while in a park district facility or program.  An exclusion may be delivered verbally or by citation by a peace officer, and/or verbally by a designated District employee, and may be followed up by a letter from the Executive Director further lengthening said exclusion for a period of time not to exceed 360 days for the first violation. Subsequent violations may mean exclusion for periods greater than one year.

2. A person excluded under any of the articles may not enter or remain upon any part of the park district facilities or programs from which said person is excluded during the period of exclusion.  An excluded person who enters or remains upon any part of the District park or recreation area/facility from which the person has been excluded is a trespasser and may be arrested and prosecuted for the crime of criminal trespass in the second degree (ORS 164.245).

3. Written notice signed by the Executive Director or designee shall be given to a person excluded from all or part of the park district facilities or programs which notice shall specify the reason for the exclusion, the places and duration of the exclusion and the consequences for the failure to comply with the notice.  The exclusion, unless it is an extension of an initial exclusion discussed in subsection VII-1 above, shall commence immediately upon delivery of the notice to the excluded person.

4. An excluded person may, within 10 days after the commencement of the written exclusion notice, appeal in writing to the Executive Director or the Executive Director's designee for review of the exclusion notice, for request of a hearing or request a written review without a hearing and a statement setting forth the reason that the Exclusion is invalid or improper.  The Executive Director or designee shall render a decision not later than 10 days after receipt of the appeal unless the excluded person requests a hearing.

5. If, as a part of a written appeal, the excluded person requests a hearing, a hearing shall be conducted by the Executive Director or designee within 10 days after receipt of the appeal and a decision shall be rendered within 10 days after the hearing.

6. At any time during the exclusion, an excluded person may petition in writing to the Executive Director or designee for a temporary waiver of the exclusion.


ARTICLE X. 

ENFORCEMENT OF RULES AND REGULATIONS

1. Any peace officer or designated District employee has the authority to refuse entrance to a park district facility and program, or to require a departure from a park district facility and program.

2. The Executive Director of the District, designated District personnel, as well as all peace officers of the State of Oregon are authorized to issue a citation as provided by Oregon law to any person who violates any provision of the rules and regulations of this District.

3. The Executive Director or any designated employee of the Bend Metro Park & Recreation District, as well as all peace officers, are vested with authority to enforce these rules and regulations.

4. The Executive Director, or any designated District personnel or a peace officer shall when authorized by law, have the authority to seize from any person property that is being used or left in violation of these rules and regulations.

5. No person shall interfere with any authorized District personnel in enforcing these rules and regulations.

6. No person shall refuse to leave any District park, recreation area, or program after being directed to leave by a peace officer, Executive Director or any designated employee of the Bend Metro Park & Recreation District.

7. Should any word, sentence, paragraph, clause, or phrase of this ordinance be adjudged or held to be void or unconstitutional, the same shall not affect the validity of the remaining portions of said ordinances, which shall remain in full force and effect.

8. The Executive Director shall have the authority to issue special permits, grant exceptions, or waivers to any of the terms of Article I for authorized events and activities.

9. Pursuant to ORS 266.450, violation of these regulations is a misdemeanor punishable by exclusion; or upon conviction by a fine not to exceed $100.00 or imprisonment not to exceed five days or both.
